Terms & Conditions
Plain-English Summary — Read This First
This section is plain language. The full legal terms govern in Sections 1–12.
Route62.fans is a discovery portal, not a shop. Every product, auction, or booking you see here belongs to an independent local vendor. When you click through and buy, you're buying directly from that vendor on their own store — not from Route62.fans.
Payment goes straight to the vendor. Route62.fans is not a payment processor, escrow agent, or party to that sale. If something goes wrong with an order, the vendor is responsible for resolving it — and Route62.fans steps in as a watchdog if you can't get a resolution directly.
One account, one region. Register once and your login works across every vendor store on this network. Your registration and browsing data sit in a central customer database operated by FAQ (Pty) Ltd for this region only — it is not shared with FAQ's other regional networks.
Your data is protected under POPIA. Full detail on what's collected, who can see it, and your rights is in Section 7.
You must be 18 or older (or have a parent/guardian's consent) to register or buy. See Section 4.1.
You accept these Terms in full when you register an account or make a purchase — registration requires an explicit checkbox, not just visiting the site. If you browse without registering, using the Portal is still conditional on these Terms, but browsing alone does not by itself form a contract. See Section 4.
Something wrong with an order or the Portal? Use the Support form — or, to return a product specifically, the Product Return Request form. Either is the fastest route to a resolution and the required first step before any formal complaint. See Sections 5.4 and 12.7.
1. Definitions & Parties
- FAQ / Route62 / "we", "us", "our" — FAQ (Pty) Ltd, trading as Route62.fans, operating the discovery portal at route62.online.
- Portal — The main Route62.fans site at route62.online: directory, town pages, "What's New" feed, community features, and account login.
- Vendor / Supplier — An independent business or individual approved to operate a Vendor Subsite under a separate agreement with FAQ (the Supplier Terms & Conditions).
- Vendor Subsite — A Vendor's dedicated WooCommerce store on a subdomain of this network (e.g. yourshop.route62.online) or a custom domain mapped to it.
- You / User / Customer — Any person who browses, registers an account on, or makes a purchase via this Portal or a Vendor Subsite reached through it.
- Network — The regional multisite network operated by FAQ under this brand (route62.online) and, where applicable, its sibling regional networks karoo.fans and gardenroute.fans, each operated as a separate, non-shared account database.
- POPIA — The Protection of Personal Information Act 4 of 2013 (South Africa).
- CPA — The Consumer Protection Act 68 of 2008 (South Africa).
2. What This Portal Is
2.1 Route62.fans is an Online Mall — a discovery portal that aggregates local vendors, their products, auctions, and bookings, and directs visitors to each vendor's own independently operated store.
2.2 Route62.fans does not manufacture, stock, sell, ship, or fulfil any product or service listed through it. Every listing you see on the Portal — homepage feeds, town pages, category pages — is pulled live from the relevant Vendor Subsite and links directly to it.
2.3 Route62.fans is not a payment processor, merchant of record, escrow agent, shipping provider, or party to any transaction between you and a Vendor. This is the same position set out in Section 2 of the Supplier Terms & Conditions that every Vendor on this network agrees to.
3. The FAQ / Supplier Relationship
This section explains, in full, how FAQ and the Vendors you buy from actually relate to each other — because it shapes what you can expect from each of them.
3.1 FAQ's Role (Mall Operator)
- Owns and operates the Portal, its hosting infrastructure, and the wider Network.
- Drives traffic to the Network through SEO, town pages, and regional marketing.
- Operates the central regional customer database, account login, and newsletter system (see Sections 4 and 6).
- Manages Google Shopping and Meta advertising sub-accounts on behalf of Vendors.
- Acts as a network watchdog — see Section 5.4 — when a Vendor doesn't resolve a customer issue directly.
- Charges Vendors a commission on completed sales. This fee is paid entirely by the Vendor and has no bearing on the price you pay.
3.2 The Vendor's Role (Independent Seller)
- Operates their own independent WooCommerce store on their Vendor Subsite, with their own payment gateway (e.g. PayFast, Yoco).
- Is the seller of record for every transaction on their store. All rights and obligations under the Consumer Protection Act — accurate descriptions, fair dealing, returns of defective goods — sit with the Vendor.
- Sets their own prices, stock levels, and shipping or pickup arrangements.
- Is solely responsible for fulfilment, customer service, complaints, and refunds arising from their own sales.
- Is approved onto the Network under a separate agreement (the Supplier Terms & Conditions) that sets out qualification criteria, fees, and conduct standards FAQ requires of every Vendor.
3.3 What This Means for You
Because FAQ and each Vendor are separate parties with separate roles, a purchase you make involves two relationships at once: your relationship with Route62.fans as the Portal you registered and browsed on (governed by these Terms), and your relationship with the Vendor as the seller you bought from (governed by that Vendor's own shop terms and the CPA). FAQ facilitates and oversees the Network; it does not stand in the Vendor's shoes for the sale itself.
4. Your Account, Eligibility & Acceptance
4.1 Registration & Acceptance of These Terms
Accounts are created via route62.online, the Network's main portal and central login. One account works across every Vendor Subsite on this Network — you do not need to register separately with each Vendor. Registration requires you to actively check a box confirming you have read and accept these Terms; that action is what forms a binding contract between you and FAQ. Making a purchase on a Vendor Subsite via a link from this Portal, without a Portal account, likewise constitutes acceptance of these Terms as they apply to Portal use, at the point the purchase is made. Simply browsing the Portal without registering or purchasing does not by itself form a contract, but your use of the Portal in that case remains subject to these Terms as a condition of access — see Section 9.
4.2 Eligibility
You must be 18 years or older to register an account or make a purchase through this Network. If you are under 18, you may only use the Portal with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf.
4.3 Accuracy & Security
- You must provide accurate registration information and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Notify us immediately if you suspect unauthorised use of your account.
4.4 One Region, Separate Accounts
Each regional network — route62.online, karoo.fans, and gardenroute.fans — operates its own separate account database at present. An account created on this Network does not automatically work on a sibling network.
4.5 Account Suspension
FAQ may suspend or close an account that breaches Section 9 (Acceptable Use), is used fraudulently, or is inactive and unverified for an extended period, in line with our data retention practices under Section 7.
5. Browsing, Links & Vendor Purchases
5.1 Links to Vendor Subsites
Product cards, town-page feeds, and search results on the Portal link directly to the relevant Vendor Subsite. Clicking through takes you to that Vendor's independently operated store, with its own checkout, its own terms, and its own privacy practices for the order itself.
5.2 Making a Purchase
All purchases are completed on the Vendor Subsite, using the Vendor's own payment gateway. Route62.fans does not process, hold, or have access to your payment details at any point in that transaction.
5.3 Accuracy of Listings
Product information, pricing, availability, and images are supplied and maintained by each Vendor. While FAQ assists with initial listing setup, FAQ does not guarantee the accuracy, completeness, or current availability of any Vendor's listing at any given time.
5.4 If Something Goes Wrong
Route62.fans is not a party to your purchase and does not process refunds on a Vendor's behalf. To return a product, use the Product Return Request form. For any other issue with an order or a Vendor, use the Support form — this is the fastest way to reach us and the required first step before any formal complaint (see Section 12.7). If you cannot get a resolution directly from a Vendor, Route62.fans may, at its sole discretion, act as a network watchdog: contacting the Vendor's decision-maker directly and seeking a fair outcome. This is a discretionary service, not a guarantee of resolution, and FAQ is under no obligation to intervene in, or to achieve any particular outcome for, a dispute between you and a Vendor. Repeated or serious failures by a Vendor are addressed under that Vendor's own agreement with FAQ, up to and including removal from the Network.
5.5 Auctions & Bookings
Where a Vendor offers auctions or bookings through their Vendor Subsite, the specific rules for that auction or booking (opening/closing times, reserve prices, cancellation terms) are set by that Vendor and displayed on the relevant listing — see Section 8.
6. The Central Regional Customer Database
Route62.fans operates a central customer database (CRM) for this region, shared across every Vendor Subsite on the Network. This is how account login, newsletters, and demand-routing features (like Help Me Find) work across the whole Network without you having to register or opt in separately with each Vendor.
- Your registration profile (name, email, town, login) is stored and managed by FAQ, not by individual Vendors.
- Vendors do not have access to the customer database, your profile, or your contact details beyond what's needed to fulfil an order you place with them directly.
- Newsletter subscriptions (Town Newsletter and any Vendor-specific newsletter you opt into) are managed centrally by FAQ under double opt-in, and you can unsubscribe or manage preferences at any time.
- Sibling regional networks (karoo.fans, gardenroute.fans) run their own separate instance of this database — your data on this Network is not shared with those networks.
7. Data Privacy, Customer Information & POPIA Compliance
7.1 What We Collect
Registration details (name, email, town, login credentials), browsing and purchase-tag data used for personalisation and anonymised demand intelligence, and newsletter subscription preferences.
7.2 Data Roles
| Data Type | Responsible Party | Vendor Access |
|---|---|---|
| Registration profile (name, email, town, login) | FAQ | None |
| Central CRM contact record & subscriber tags | FAQ | Own newsletter stats only |
| Order placed with a specific Vendor (delivery details) | Vendor | Full — needed for fulfilment |
| Help Me Find / wishlist requests | FAQ | Anonymised count only — no identities |
7.3 Why Your Data Is Collected
To let you log in once across every Vendor Subsite, to send the newsletters you opt into, to route demand-matching requests (Help Me Find) to relevant Vendors without exposing your identity, and to maintain network-wide security and fraud prevention.
7.4 Your Rights
Under POPIA, you may request access to, correction of, or deletion of your personal information at any time via the account area or the POPIA removal form on this site. Requests are handled exclusively by FAQ and actioned within a reasonable time, as POPIA requires; FAQ's internal target is 21 days for most requests, but this is an operational goal, not a fixed contractual deadline, and more complex requests may take longer. Vendors are not involved in processing these requests.
7.5 Third-Party Processors
FAQ uses third-party service providers (e.g. email delivery, hosting, SMS gateway) strictly to operate the Portal and Network. These providers process data on FAQ's instruction and are not permitted to use it for their own purposes.
8. Auctions, Bookings & Wishlists
8.1 Auctions
Where offered, auctions run on the schedule and reserve terms set by the individual Vendor and displayed on the listing. Placing a bid is a binding offer to that Vendor, subject to their listing terms.
8.2 Bookings
Where offered, bookings (accommodation, appointments, rentals) are made directly with the Vendor. Availability, cancellation, and refund terms are set by that Vendor and displayed on the listing before you confirm.
8.3 Help Me Find & Wishlists
Wishlist and "Help Me Find" requests let you flag demand for a product not currently listed. FAQ shares only anonymised counts with Vendors — your identity is never disclosed without your separate, explicit consent.
9. Acceptable Use
When using this Portal, you agree not to:
- Attempt to circumvent, scrape, or interfere with the Portal's security, feeds, or normal operation.
- Impersonate another person or misrepresent your identity when registering or contacting a Vendor.
- Use the Portal or its links to engage in fraud, harassment, or any unlawful conduct.
- Submit false, misleading, or defamatory reviews, complaints, or wishlist requests.
FAQ reserves the right to suspend or remove access for any User who breaches this section.
10. Intellectual Property
10.1 The Route62.fans brand, logos, town-page content, and Network design are the intellectual property of FAQ (Pty) Ltd and may not be reproduced without written consent.
10.2 Product images, descriptions, and content displayed on a Vendor Subsite remain the intellectual property of that Vendor.
10.3 Any feedback, reviews, or content you submit through the Portal may be displayed publicly and may be used by FAQ for Network marketing purposes, unless you request otherwise.
10.4 Where a Vendor lists or sells a product bearing a third-party brand, trademark, or other producer's intellectual property, that product remains subject to the intellectual property rights of the original producer or brand owner. Listing such a product on a Vendor Subsite does not transfer, license, or grant any intellectual property right in that brand to the Vendor, to FAQ, or to you as a buyer. FAQ does not verify a Vendor's right to sell branded third-party goods and is not liable for any infringement arising from a Vendor's listing — responsibility for lawful sourcing and sale of branded products rests with the Vendor.
11. Liability & Disclaimers
11.1 To the fullest extent permitted by South African law, FAQ is not liable for any loss arising from a transaction between you and a Vendor, including defective goods, non-delivery, misdescription, or a Vendor's failure to honour a booking or auction.
11.2 FAQ is not liable for indirect, incidental, or consequential loss arising from use of the Portal, save where such liability cannot lawfully be excluded under the Consumer Protection Act.
11.3 Nothing in these Terms limits any right or protection you have under the CPA that cannot lawfully be excluded.
11.4 FAQ makes reasonable efforts to keep the Portal available and accurate but does not guarantee uninterrupted access, and is not liable for downtime, technical faults, or third-party service outages (e.g. payment gateways operated by Vendors).
11.5 For FAQ's own direct acts or omissions in operating the Portal and the central regional customer database (as distinct from any Vendor's conduct, which is addressed above), FAQ's total liability to you, however arising, is limited to R5,000 or the amount of any fees you have paid directly to FAQ in the 12 months before the claim arose (which for most Users, who pay FAQ nothing directly, will be nil), whichever is greater — except where such a limit cannot lawfully be excluded or capped under the CPA or POPIA.
11.6 Product prices, stock availability, and lead times shown on a Vendor Subsite are determined and maintained by that Vendor, not by FAQ. A sale takes place at the price displayed and in effect at the time the order is placed. Each Vendor is responsible for keeping their own prices and stock levels accurate and up to date; FAQ does not verify pricing or stock accuracy on a Vendor's behalf and is not liable for loss arising from a Vendor's outdated price or stock listing.
12. General Provisions
12.1 Governing Law. These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of the South African courts.
12.2 Severability. If any provision is found unenforceable, the remaining provisions continue in full force.
12.3 Entire Agreement. These Terms constitute the entire agreement between you and FAQ regarding use of the Portal and supersede any prior version.
12.4 Relationship to Other Terms. These Terms govern the Portal only. Your purchase from a specific Vendor is additionally governed by that Vendor's own shop terms, displayed on their Vendor Subsite. The Supplier Terms & Conditions govern the separate FAQ↔Vendor commercial relationship and are not incorporated into your relationship with FAQ as a shopper.
12.5 Amendments. FAQ may update these Terms at any time. Where a change is material, FAQ will give at least 30 days' notice by emailing registered account holders at their registered address and by displaying a prominent notice banner on this page for the notice period. The current version, with its effective date, is always published at this page; continued use of the Portal after a material change takes effect constitutes acceptance of the updated Terms.
12.6 Notices. All formal notices to FAQ should be submitted via the Support page.
12.7 Complaints & Dispute Resolution. Before raising a formal complaint or legal claim, you agree to first submit the issue via the Support form (or, for a product return specifically, the Product Return Request form) and allow FAQ a reasonable opportunity — normally 14 days — to respond or resolve it. This step does not apply to POPIA data-subject requests (Section 7.4), which are handled through the account area or the POPIA removal form, or to any right you have to approach the National Consumer Commission, the Information Regulator, or a court directly, which this clause does not limit or delay.
Common Questions
These answers are derived from the sections above and are provided for ease of reference. The full clauses govern in all cases.
Who do I actually buy from on Route62.fans?
The Vendor. Every purchase happens on the Vendor's own independent store, not on the Portal. Route62.fans is not a payment processor or party to the transaction.
Where is my account and order data stored?
Your registration profile sits in a central regional customer database operated by FAQ. Order and delivery details for a specific purchase go to the Vendor you bought from, for fulfilment only.
Is my login shared across karoo.fans or gardenroute.fans?
No. Each regional network runs its own separate account database at present.
How do I stop receiving marketing emails?
Every newsletter includes an unsubscribe link. You can also manage subscriptions or request removal at any time via your account or the POPIA removal form.
What happens if a Vendor doesn't resolve my complaint?
Route62.fans acts as a network watchdog — we contact the Vendor's decision-maker directly and facilitate a fair outcome. Serious or repeated failures can lead to that Vendor's removal from the Network.
Do I have to complain to FAQ before taking legal action?
Yes, for general disputes — submit the issue via the Support form (or the Product Return Request form for a return) and allow FAQ 14 days to respond, per Section 12.7. This does not apply to POPIA requests or to your right to approach a regulator or court directly.
